These Terms of Service ("Terms") govern your use of the Pool Vault mobile application ("App") operated by Pool Vault ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to create an account and use Pool Vault. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you represent that you meet these requirements.

2. Description of Service

Pool Vault is a pool maintenance assistant that provides:

AI-powered test strip image analysis to extract chemical readings
Personalized treatment recommendations with calculated chemical dosages
Pool health scoring and historical tracking
Chemical and equipment inventory management
Maintenance and chemical addition logging
Troubleshooting guidance for common pool problems
Weather and UV index information

The App is designed as a helpful tool for pool owners. It is not a substitute for professional pool service, water testing laboratories, or expert advice.

3. Disclaimer of Accuracy

AI-generated chemical readings and recommendations are estimates only. While we strive for accuracy, results can be affected by:

Lighting conditions at the time of scanning
Test strip quality, age, or storage conditions
Timing of the reading (strips must be read within the manufacturer's recommended window)
Camera quality and focus
Color variations between strip brands and batches

You should always verify important readings with a secondary test method (such as a liquid test kit or professional lab test) and consult a pool professional if you are unsure about any treatment. You are solely responsible for any actions you take based on the App's recommendations.

4. User Accounts

To use Pool Vault, you must create an account with a valid email address and password. You are responsible for:

Providing accurate and complete registration information
Maintaining the confidentiality of your login credentials
All activity that occurs under your account
Notifying us promptly of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or are suspected of unauthorized access.

5. Subscriptions and Payments

5.1 Free Tier

Pool Vault offers a free tier that includes 3 AI test strip scans, unlimited manual test entry, the full health dashboard, chemical and equipment inventory, and maintenance logging.

5.2 Premium Subscription

The Premium subscription ($4.99/month) provides unlimited AI scans, the smart shopping list, and priority support. Subscriptions are billed through the Apple App Store and are subject to Apple's payment terms and policies.

5.3 Billing and Cancellation

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
You can manage or cancel your subscription in your device's Settings under Subscriptions.
Cancellation takes effect at the end of the current paid period — you retain access until then.
Refunds are handled by Apple according to their refund policy.
We do not offer prorated refunds for partial billing periods.

5.4 Price Changes

We may change subscription pricing with reasonable notice. Price changes take effect at the start of the next billing period after the change. If you do not agree with a price change, you may cancel your subscription before it renews.

6. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable laws
Attempt to reverse-engineer, decompile, or extract the AI models or source code
Upload content that is illegal, harmful, threatening, defamatory, or violates third-party rights
Interfere with, disrupt, or overload the App's servers or infrastructure
Attempt to gain unauthorized access to other users' accounts or data
Share your account credentials with others or allow multiple people to use a single account
Use automated tools, bots, or scrapers to access the App
Resell, redistribute, or commercially exploit the App or its content without our written permission

7. Intellectual Property

The Pool Vault app, including its design, user interface, code, AI models, algorithms, recommendation engine, content, graphics, and documentation, is the intellectual property of Pool Vault and is protected by copyright, trademark, and other applicable laws.

Your use of the App grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not grant you any ownership rights in the App.

8. User Content

You retain ownership of any content you upload to Pool Vault, including test strip photos, notes, and pool data. By uploading content, you grant us a limited license to store, process, and display that content solely for the purpose of providing the service to you.

We do not claim ownership of your data. When you delete your account, all your content is permanently removed.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

Pool Vault is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or that AI analysis results will be accurate or complete.
We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damage to your pool, pool equipment, pool surfaces, or property resulting from following AI-generated recommendations.
Our total liability to you for any claims arising from the use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Pool Vault, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by deleting it from the App's Settings. Upon termination, all your data will be permanently deleted. Active subscriptions must be cancelled separately through the App Store to avoid continued billing.

12. Dispute Resolution

Any disputes arising from these Terms or your use of Pool Vault shall be governed by the laws of the State of Delaware, without regard to conflict of law principles. You agree to attempt to resolve disputes informally by contacting us at support@shepridge.com before pursuing formal action.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pool Vault regarding your use of the App and supersede any prior agreements.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes, we will notify you through the App or by email. Your continued use of Pool Vault after changes constitutes acceptance of the updated Terms.
